Alberta Lift and Equipment Rentals Inc. Damage Waiver
Customer’s General Responsibility
Under the Alberta Lift and Equipment Rentals Inc. (the “Company”)’s rental contract (“Contract”), the customer is responsible to the Company for any loss or damage to the rental equipment (as defined below) and for its return in the same condition in which received, except for ordinary wear. Such responsibility shall amount to the replacement or repair cost of the rental equipment at the time it is lost or damaged, plus an administrative fee and the Company’s related losses, such as, but not limited to, loss of use, appraisal fees or costs of recovery. In the event that the customer is responsible for damage to the rental equipment, such rental equipment may be repaired either by the Company or a repairer of its choosing.
The Damage Waiver (“DW”) offered by the Company, if purchased by the customer, contractually relieves the customer of responsibility, subject to the provisions herein, for minor physical damage or loss of any rental equipment (as defined below) up to a limit of $2,000.00, including associated costs.
No Insurance; DW Optional
The customer should be aware that the DW offered by the Company IS NOT INSURANCE. The DW should be used in conjunction with other insurance for DW exclusions. When deciding whether or not to purchase the DW, you may wish to check with your insurance representative or credit card company to determine whether, in the event of damage to, or theft of, the rental equipment, you have coverage or protection for such damage or theft and the amount of your deductible or out-of-pocket risk. The DW offered by the Company is completely optional as it will benefit some customers and not others. The customers must indicate whether they desire to accept or decline the coverage. If the customer accepts the DW the amount will be added to the contract prior to the rental agreement being signed. The Damage Waiver is non-refundable. The Company has the option to decline the DW to customers.
Use of Rental Equipment
All customers, while in the possession of rental equipment from the Company, shall operate all machines, equipment and attachments (the “rental equipment”) in correspondence with all advice, recommendations, laws and guidance set forth by the company, manufacturers and province. This information can be found in the owner’s/operator’s manual warnings and instructions on how to use the equipment safely and properly are listed on the equipment. All customers are responsible for any loss and or damage to the rental equipment during the term of the contract.
Costs and Blanket DW
The cost of the DW is 10% of the total Contract. If the customer extends the Contract past the original due date, additional DW costs will apply. The DW can automatically be applied to all Contracts used by a customer known as a blanket DW. If the customer wishes to remove the blanket DW, a release of the blanket DW (as attached) must be signed, or in the alternative, written notice must be provided to the Company bearing the date and an original signature of the customer or the authorized representative of the customer. The blanket DW will not apply to any Contract opened after the date of removal of the blanket waiver. The blanket DW cannot be removed from existing Contracts.
Coverage and Exclusions
The Company’s DW covers any crease in the metal on equipment, hole punches, scratches, scuffs, decal replacement and bending up to $2,000. The Company’s DW does not cover any negligence, misuse/abuse, glass breakage, tire repair/replacement, damage above $2,000, cracks, theft, vandalism, rollover, improper maintenance, use by unauthorized users and any accidents that happen while the rental equipment was not being used in an acceptable manner established by the Company, manufacturer or by any statute or regulation. The customer is responsible for all damage not covered in this Damage Waiver.
